Welcome to Balloons by Tabitha. These Terms & Conditions ("Terms") govern your use of balloonsbytabitha.com (the "Website") and your purchase of products and services from Balloons by Tabitha.
Balloons by Tabitha is operated by The Tab Edit, LLC, a California limited liability company, doing business as Balloons by Tabitha ("Balloons by Tabitha," "Company," "we," "us," or "our").
By accessing our Website, placing an order, submitting payment, or purchasing products or services from us, you acknowledge that you have read, understood, and agree to these Terms, as well as our Privacy Policy, Refund Policy, and Delivery & Pickup Policy.
1. Products & Services
Balloons by Tabitha provides premium balloon bouquets, helium balloon arrangements, personalized balloon options, select custom balloon décor, and related products and services.
All products and services are subject to availability.
Product photographs are intended to represent the overall appearance and style of our products. Because each arrangement is individually created and balloons are manufactured products that may vary, your finished arrangement may have reasonable variations from photographs shown on our Website or social media.
2. Orders & Payment
All orders must be paid 100% in full at the time of purchase.
An order is not confirmed, and a requested pickup or delivery date and time are not reserved, until full payment has been received and the order has been accepted by Balloons by Tabitha.
Prices are subject to applicable sales tax, delivery charges, personalization charges, rush fees, and other applicable fees disclosed at or before checkout.
We reserve the right to refuse or cancel an order because of product availability, scheduling limitations, pricing or listing errors, suspected fraud, unsafe circumstances, or other reasonable circumstances preventing fulfillment.
If we cancel an order after payment because we are unable to fulfill it, and an acceptable alternative cannot be arranged, we will refund the amount paid for the affected order.
3. Returns, Exchanges & Cancellations
Due to the made-to-order and perishable nature of our products, we do not accept returns, exchanges, or order cancellations.
All sales are final once an order has been placed.
Please review your order carefully before completing your purchase, including the product, colors, personalization, delivery or pickup information, date, and other selections.
Please see our Refund Policy for additional information regarding damaged, defective, or incorrect items.
4. Curated Designs & Customization
Our balloon collections are intentionally curated by Balloons by Tabitha.
Purchasing a balloon bouquet does not automatically include custom design services.
Customers may select only those modifications, personalization options, colors, wording, or other choices specifically offered for a product unless Balloons by Tabitha separately agrees to a custom request.
Custom design services, additional personalization, or modifications outside the options offered on the Website may require additional fees and are subject to availability.
We reserve the right to decline customization requests.
5. Personalization
Customers are responsible for providing accurate names, spelling, dates, wording, and other personalization information.
Please carefully review personalization before submitting your order.
Balloons by Tabitha is not responsible for errors in the finished product resulting from incorrect information provided by the Customer.
6. Colors & Product Variations
We make every reasonable effort to accurately represent our balloon colors and products.
However, colors may appear differently depending on screen settings, photography, lighting, balloon size, inflation, manufacturer variations, and environmental conditions.
Minor variations in balloon color, shape, size, arrangement, ribbon placement, embellishments, and overall appearance are inherent in handcrafted balloon products and are not considered defects.
7. Product Availability & Substitutions
Balloon colors, brands, specialty balloons, ribbons, weights, embellishments, and other materials are subject to supplier availability.
If a particular item becomes unavailable, discontinued, defective, delayed, or otherwise unsuitable, Balloons by Tabitha may substitute an item of comparable quality, value, color, or style when reasonably necessary.
We will make reasonable efforts to preserve the overall aesthetic of the selected design.
8. Balloon Float Time
Balloons are temporary and perishable products.
Float time varies based on balloon type, size, treatment, temperature, weather, altitude, transportation, handling, storage, and environmental conditions.
Any estimated float times appearing on our Website, product descriptions, social media, care instructions, or other materials are provided for general informational purposes only.
Estimated float times are not guarantees or warranties.
Balloons by Tabitha does not guarantee any specific balloon float time or product lifespan.
9. Balloon Care
Customers are responsible for properly caring for balloons after delivery or pickup.
Whenever possible, balloons should be kept indoors at a comfortable room temperature and away from direct sunlight, extreme heat or cold, sharp objects, rough surfaces, pets, ceiling fans, sprinklers, and other hazards.
Heat may cause balloons to expand and pop. Cold temperatures may cause helium balloons to temporarily shrink or appear deflated.
Once balloons have been successfully delivered, installed, or accepted at pickup in satisfactory condition, Balloons by Tabitha is not responsible for subsequent popping, deflation, oxidation, tangling, escaping balloons, or other damage resulting from handling, transportation, weather, environmental conditions, or circumstances outside our control.
10. Balloon Safety
Balloons and accessories are decorative products and should be handled responsibly.
Children should be supervised around balloons. Uninflated and broken balloons may present a choking hazard and should be immediately discarded.
Ribbons, strings, embellishments, and other accessories may present choking, strangulation, or entanglement hazards.
Helium must never be inhaled.
Foil balloons may conduct electricity and must be kept away from electrical lines and equipment.
Balloons by Tabitha does not participate in intentional helium balloon releases.
11. Delivery & Pickup
Delivery and pickup orders are subject to our separate Delivery & Pickup Policy, which is incorporated into these Terms.
Customers are responsible for providing accurate delivery information and ensuring appropriate access and availability to receive an order.
12. Website Information
We make reasonable efforts to ensure that Website information, descriptions, photographs, availability, and pricing are accurate.
We reserve the right to correct errors, update information, change prices, modify or discontinue products, or cancel orders affected by an obvious pricing or listing error.
13. Intellectual Property
Unless otherwise indicated, original photographs, product descriptions, graphics, branding, collection names, text, designs, Website content, and other original materials created by Balloons by Tabitha are owned by or licensed to The Tab Edit, LLC.
Such content may not be reproduced, copied, sold, distributed, republished, or commercially used without prior written permission.
14. Photography & Marketing
Balloons by Tabitha may photograph completed balloon arrangements and décor for portfolio, Website, advertising, and social media purposes.
We make reasonable efforts to focus photography on our work rather than event guests.
If you do not want your order, personalization, event location, or identifiable event details photographed or shared, please notify us in writing before delivery or your event.
15. Limitation of Liability
To the fullest extent permitted by applicable law, The Tab Edit, LLC d/b/a Balloons by Tabitha will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the purchase, use, transportation, handling, installation, storage, or display of our products or services.
To the fullest extent permitted by applicable law, our total liability arising from a particular order or service will not exceed the amount actually paid to us for the product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
16. Circumstances Beyond Our Control
We are not responsible for delays or inability to perform caused by circumstances reasonably outside our control, including severe weather, natural disasters, accidents, road closures, government restrictions, power outages, supplier disruptions, venue closures, emergencies, or other extraordinary circumstances.
We will make reasonable efforts to communicate with affected Customers and determine an appropriate resolution based on the circumstances.
17. Governing Law & Disputes
These Terms and transactions with Balloons by Tabitha are governed by the laws of the State of California.
Before initiating formal legal proceedings, you and The Tab Edit, LLC agree to make a good-faith effort to resolve the dispute directly.
Nothing in these Terms limits rights or remedies that cannot legally be waived under applicable law.
18. Changes to These Terms
We may update these Terms periodically.
The version in effect at the time an order is placed will generally govern that transaction unless otherwise required by law or agreed in writing.
